These Terms & Conditions ("Terms") govern your access to and use of the Arlington Color Run website, event registrations, donations, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. About Arlington Color Run
Arlington Color Run ("ACR," "we," "our," or "us") is a nonprofit organization organized under Section 501(c)(3) of the Internal Revenue Code. ACR hosts community events and fundraising activities in support of charitable causes, including partnerships with ALSAC/St. Jude Children’s Research Hospital.
2. Eligibility and Participation
You must be at least 18 years old to register or donate independently. Individuals under the age of 18 may participate in events only with the consent and supervision of a parent or legal guardian.
By registering for an event, you affirm that all information provided is accurate and complete and that you are physically able to participate safely.
3. Event Registration and Participation
Event registrations are subject to availability and may close without notice. ACR reserves the right to modify event details, including date, time, location, activities, or offerings, due to weather, safety concerns, governmental directives, or circumstances beyond our control.
Participants acknowledge that participation in events involves inherent risks, including physical injury, exposure to weather conditions, crowds, and colored powders. Participation is voluntary and at your own risk.
4. Donations and Payments
All donations are voluntary. Donations may be tax-deductible to the extent allowed by law. No goods or services are provided in exchange for donations unless explicitly stated.
Payments and donations are processed through third-party platforms (such as Zeffy or other payment processors). ACR does not store full payment card or banking information and is not responsible for the privacy practices or technical issues of third-party processors.
5. Refund and Cancellation Policy
Event registrations and donations are generally non-refundable, except as required by law or explicitly stated otherwise.
If an event is canceled or rescheduled, ACR may, at its discretion, offer participants options such as transfer of registration, deferral to a future event, or conversion of registration fees to a donation.
6. Assumption of Risk and Release of Liability
By participating in any ACR event, you knowingly and voluntarily assume all risks associated with participation. To the fullest extent permitted by law, you agree to release, waive, and hold harmless Arlington Color Run, its officers, directors, volunteers, sponsors, partners, affiliates, the Town of Arlington, its elected officials, employees, agents, and representatives from any claims, liabilities, damages, or causes of action arising out of or related to participation.
ACR events may take place on property owned, operated, or permitted by the Town of Arlington. The Town of Arlington and its representatives shall have no responsibility or liability for personal property loss or damage incurred during participation.
Parents or legal guardians of minor participants agree to these terms on behalf of themselves and the minor.
7. Photography, Video, and Media Release
By participating in ACR events or using the Services, you grant ACR permission to use photographs, video recordings, and other media captured during events for promotional, educational, or fundraising purposes without compensation.
8. Intellectual Property
All content on the ACR website, including text, logos, graphics, images, and designs, is the property of Arlington Color Run or its licensors and is protected by applicable intellectual property laws. Unauthorized use is prohibited.
9. Prohibited Conduct
You agree not to:
Use the Services for unlawful or fraudulent purposes
Disrupt or interfere with events, the website, or other participants
Misrepresent your affiliation with ACR
Attempt to gain unauthorized access to systems or data
ACR reserves the right to deny participation or access to anyone who violates these Terms.
10. Third-Party Links and Services
The Services may contain links to third-party websites or services. ACR is not responsible for the content, policies, or practices of third parties and provides such links for convenience only.
11. Force Majeure
ACR shall not be liable or responsible for failure or delay in performing any obligation under these Terms when such failure or delay results from events beyond its reasonable control, including but not limited to acts of God, severe weather, natural disasters, fire, flood, lightning, tornadoes, hurricanes, pandemics, public health emergencies, war, terrorism, civil unrest, governmental orders, labor disputes, utility failures, or venue unavailability (each, a "Force Majeure Event"). In the event of a Force Majeure Event, ACR reserves the right to cancel, postpone, modify, or relocate an event without liability.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith informal discussions. If unresolved, disputes shall be resolved through mediation or binding arbitration in Tennessee, unless prohibited by law.
13. Limitation of Liability
To the maximum extent permitted by law, ACR shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the Services or participation in events.
14. Changes to These Terms
ACR reserves the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Services constitutes acceptance of the revised Terms.
